Ekiti State Police Command, Ado-Ekiti, has invited Governor Ayodele Fayose's media aide, Lere Olayinka, and three others to answer charges against them by Ado-Ekiti lawyer, Adeoye Aribasoye, over alleged violation of Cybercrime Act.
In the petition to the Commissioner of Police by his lawyer, A.A Daramola, Aribasoye complained that Olayinka and three others were engaged in alleged incessant criminal attacks founded on falsehood against some eminent personalities who are his guarantors, the consequence of which he had missed many opportunities that would have accrued to him if Olayinka and others had not tarnished their image, contrary to Section 24 of the Cybercrimes (Prohibition, Prevention ETC) Act 2015.
Investigation revealed that the petition had been referred by the Commissioner of Police to the OC SIB for investigation.
It was also learnt that OC SIB had written an invitation letter to Olayinka while three others' Bola Agboola, Debola Akingbade and Adebomojo Akeem, have also been invited to make their statements.
It is not clear if they have honoured the invitation.
Adeoye explained that he was invited by the investigating police officer (IPO) in charge of the matter at SIB and he had made statement to the police in furtherance of the investigation.
He noted that with the level of evidence available to the police, the culprits would be made to face the music over their deliberate infractions of the provisions of Cybercrime Act.
In the petition, Daramola wrote:
"We act as Solicitors for Barrister Adeoye Stephen Aribasoye a mentee of Dr. John Kayode Fayemi (hereinafter called Our Client) and we have our Client’s instruction to write this petition.
"Our Client and his Mentor are law abiding citizens of the Federal Republic of Nigeria seeking the protection of the Nigeria Police Force against incessant and unabated criminal character assassination of Dr. John Kayode Fayemi by the above named culprits namely; Lere Olayinka, Bola Agboola, Debola Akingbade, Adebomojo Akeem and their cronies working in concert with them.
"Our Client informed us that the above named persons have continuously and intentionally been posting criminal and malicious, false and offensive messages on Facebook, twitter and other social media platforms for the purpose of causing annoyance, inconvenience danger, obstruction, insult, injury, criminal intimidation, enmity, hatred, ill-will or needless anxiety against the person of Dr. John Kayode Fayemi who is Our Client’s Mentor, Guardian, Benefactor and Referee.
"Our Clients informed us that the said criminal and malicious acts of these persons have caused him to lose out on job interviews as references have severally been made to those malicious postings by these culprits and their cronies.
"Our Client further informed us that due to the fact that Dr. Kayode Fayemi was on the list of his guarantors and referees, he has been put at a disadvantage on number of opportunities as a result of their deliberate criminal acts of tarnishing and causing annoyance, inconvenience danger, obstruction, insult, injury, criminal intimidation, enmity, hatred, ill will or needless anxiety against the person of mentor, Dr. John Kayode Fayemi.
"References have particularly been made to those criminal and malicious posts which have misled the general public to doubt the integrity and character of his mentor and guarantor subjecting him to an unwarranted public ridicule, odium, embarrassment, and unprecedented disrepute.
"Our Client has always cherished the odyssey and track records of his Mentor and Benefactor whom he regards as a gentleman per excellence, a man of unquestionable character and one of the few Public Servants whose zero tolerance for corruption is unquestionable and unassailable. "Unfortunately, the culprits mentioned above have jeopardized and adversely affected this image by their unabated criminal acts and unwarranted character assassination of his person.
"Our Client also informed us that the acts of these culprits and their cronies are in contravention of Section 24 of CYBERCRIMES (PROHIBITION, PREVENTION, ETC) ACT, 2015.
"The instances below are set out by Our Client as part of the infractions and infringements noted against the person of Dr. Kayode Fayemi:
"On November 24, 2016 at 8:41pm Lere Olayinka posted on FACEBOOK “….Dr. John Kayode Fayemi is a THIEF and in a saner clime, he will be in JAIL for stealing Ekiti State money.” A printed copy of the post is hereby attached as Annexure “A”
"On 29 day of November, 2016 at 10:51am same Lere posted on FACEBOOK “ … I am yet to see Fayemi Court papers. May be he has forgotten, I’m reminding him that he needs to go to court and sue me for DEFAMATION of his already DEFAMED CHARACTER …Here are Fayemi’s phone numbers 08083088708, 08055556655 Pls, help me remind him to instruct his lawyer to go to court now now now oooo: Abi na me talk make Fayemi steal Ekiti SUBEB N850m? ….”

"On the same 29th day of November, 2016 Lere Olayinka continued in his unwarranted, unguarded, malicious and character assassination of Dr. John Kayode Fayemi by posting on FACEBOOK 'I was not afraid of FAYEMI when he was a governor with executive powers, is it now that he is a common NOISEMAKER that I will be afraid of him?' A printed copy of this post is hereby attached as ANNEXURE “C”
"On July 2, 2016 at 2:34pm same Lere Olayinka posted on his FACEPOOK wall, “Ekiti Chief Judge, Daramola bribed with N20m to frustrate cases on Fayemi’s creation of new LGs…Referendum to be conducted without SIEC” A printed copy of the post is also attached as ANNEXURE “D”
"That sometimes in July 2016, Bola Agboola on his part wrote on his FACEBOOK wall that a whopping some of N1.5b Ekiti money was donated by Dr. Fayemi to the campaign fund of Buhari. An head turn down portrait of President Buhari was uploaded with a claim “… Kai Baba you be thief!” A printed copy of the post is hereby attached as ANNEXTURE “E”
"On June 15, 2017 at 10:25pm the trio variously and severally posted on Debola Akingbade Facebook thread, calling Our Client’s mentor, guardian and referee all manner of unprinted names to wit: “Who’s Fayemi? That thief?” – Lere Olayinka; “Aresa baba, Fayemi is not a thief ow, he is a rouge, and pen robber.. Thief ke?...” – Debola Akingbade; “Scientific robber.” – Bola Agboola. A printed copy of the said comments is hereby attached as ANNEXURE “F”
"It is also on records that the trio at various times and severally made offending, insulting and malicious posts against the President of the Federal Republic of Nigeria, President M. Buhari; the First Lady of the Federal Republic of Nigeria, Hajia Aisha Buhari, among other eminent Nigerians, the trio has been subjected to public opprobrium and ridicule.
"We commend their FACEBOOK pages and twitter handles, among others, for your further investigation.
"A forged letter purportedly written by the Ekiti State APC spokesperson posted by Bola Agboola on July 2, 2016 at 2:34pm and another evil and callous post against the President of the FRN by Debola Akingbade are hereby attached as ANNEXURE “G” and “H” respectively.
"On November 14, 2017, Lere Olayinka in continuation of his criminal violation of Cybercrime Act published on his Facebook page, “₦50m BED & ₦500m FLOWERS in Ekiti, now another ₦700m for WEBSITE in Abuja. Buoda Kayode Fayemi, you too dey steal ooooo!” A copy of this offensive post is attached as Annexure “I”
"Adebomojo Akeem on his part criminally defamed Dr. Kayode Fayemi in a comment made on Lere Olayinka’s wall on Novemeber 13, 2017 at 2:48pm when he commented as follows: “APC social miscreants were defending the statement credited to that fraudster, Fayemi, the Minister of Steal…”https://m.facebook.com/home.php?s=1805606262&sstr=10208450710584395&stype=s&postid=10208450710584395&gfid=AQBquRkP8t7SA194&_rdr#!/profile.php?id=1380833650&ref=content_filter A screenshot of this offensive comment is hereby attached as Annexure “J”
"Our Client further informed us that as a result of the above and several other malicious, provocative, myopic, untrue, and ungodly reckless postings of the trio against his mentor, guardian, benefactor, and referee, he has been inundated with various calls from family members and friends who are disappointed that his mentor could soil his hands and regard him as a fraudulent person who siphoned public funds at the detriment of the people of Nigeria particularly Ekiti State.
"Our Client further informed us that most of the posts were viewed on either his HP Laptop and on his Microsoft mobile particularly when he was in Abuja.
"That most of his friends in and around Abuja have had reason(s) to point his attention to these mindless posts of the trio against his mentor and benefactor.
"Our Client informed us that Mr. Lere Olayinka is the current Special Assistant to the Governor of Ekiti State on New Media who also doubles as the Director General of the BSES, a station that has also been turned into medium of hate speeches, lies and propaganda against eminent personalities who do not share the same view with the current Governor of Ekiti State, Mr. Peter Ayodele Fayose.
