INEC refuses to bring witnesses because they could not find anyone to come and lie under oath ~ Demola Olarewaju
PEPT resumes this morning about this time - 9:30am, I’m sure by now those interested in the outcome of this matter have heard of the disastrous first steps of the Buhari defence: two major fumbles yesterday alone and several others that have been identified and will be exploited.
Worthy to note that H.E. Peter Obi was in court yesterday - these are men who fully understand how to go the whole distance in any election and how to stand consistently by what you believe in.
If history is to go by, Atiku/Obi are two men with a record of judicial victories.
Two of the issues against Buhari is that he wasn’t qualified to run for office and that he swore on and submitted a false and outdated affidavit to INEC for the 2019 election.
This burden is what the Buhari legal team tried to upturn yesterday but shot itself in the foot.
The brilliance of the Atiku electoral petition, which I and some others have carefully highlighted long before the matter commenced and urged others to download and read, is in the fact that it comes from various angles and seeks various reliefs from the PEPT.
The matter of the INEC server is directly to back up our claim that Atiku won the election by INEC figures - nobody expected INEC to deny owning any server whatsoever.
In a few days, more details on this server will be put out - along with internal communications from INEC.
This issue of server is central to avoiding another expensive rerun as it proves conclusively that Atiku won - anyone who has a problem with it should put pressure on INEC to open up about it: inspection of all election related materials is routine post-election procedure.
The server matter has to do directly with INEC and as mentioned before now, INEC provided no defence.
That specific issue is now before the Supreme Court and judgement has been reserved - forgotten the date but it is quite soon and should be on news websites anyone can google.
The other aspects of the petition which his defence team is now grappling with are:
The schools Buhari claimed to have attended were not in existence at the time he claimed to have attended them.
To debunk this, his lawyers brought pictures and an old schoolmate to testify.
What Atiku presented were documented evidence from the National Archives which show that those schools simply did not exist as named in the years Buhari said he attended them.
I could be more detailed but these are things anyone interested can google and find out more about.
To contest in INEC elections, academic certificates are listed.
In Buhari’s case, he did not present a single academic certificate to INEC, he rather swore an affidavit that was dated October 24, 2014 - clearly outdated, and stating that his certs are with the military board.
This assertion has been proven by the PDP with submitted videos of the army debunking the claim of being with Buhari’s certificates.
Buhari’s very first witness, Maj. Gen. Paul Tarfa then confirmed it at the PEPT yesterday: nobody submitted their certs to the military.
The follow-up question to Paul Tarfa under cross examination by Dr. Livy Uzoukwu (Atiku’s Lawyer) was quite instructive: he merely confirmed that as President and C-in-C, all military formations are under Buhari’s command.
The petition has the answer but let’s keep it moving 🤫
The second Buhari witness was an old schoolmate and he confirmed Buhari attended the same school with him - but this does nothing to weaken the petition’s assertion that the schools were not in existence as at the time Buhari said he attended.
Buhari got the dates totally wrong.
Dr. Livy Uzoukwu then established that pictures are not the same as certificates and that no certificate was tendered to INEC, despite claiming to have two.
3rd witness was Abba Kyari, Chief of Staff to Buhari - he came to back up the claim that Atiku is a Cameroonian 🥶🥶
Dr. Livy debunked that quite easily by referencing the APC convention which Atiku participated and contested in, along with Buhari and in which Abba Kyari participated.
Then came the second entrapment of the 3rd witness, Kyari was no match for Dr. Livy and another error occurred
Uzoukwu got Kyari to confirm that Buhari presented no certificates whatsoever to INEC, not a single one - he merely listed institutions attended.
This is key to the petition - this is exactly where Buhari is unqualified: he did not present any certificate at all to INEC.
To remedy that, Buhari’s lawyers submitted a Cambridge Assessment Statement to the PEPT yesterday - note that this is still not a certificate, and it was still not submitted to INEC before the election.
Because Abba Kyari only went to pick it up on July 18, 2019.
Buhari’s lawyers tried to ambush PDP by submitting the documents only that morning - Dr. Livy however spotted and noted that Kyari had written his entire witness statement before even going to pick up the assessment document from Cambridge on July 18.
Another error.
Dr. Livy: “Does it surprise you that your witness statement is signed before collection of documents from Cambridge?”
Kyari: “...I’m not surprised.”
*Crickets*
Case adjourned till this morning - we wait to see how today turns out but so far, so good - we dey thank God o.
If Justice is upheld and if facts count with the Judiciary, #AtikuIsComing is only a matter of time.

My joy is that the Atiku petition is too detailed to be fully countered - there are so many issues that I doubt the respondents can counter them all.
The question on military command for instance, posed innocuously by Dr. Livy could relate to army deployments on Election Day.
It could also be related to the certificates with the military board - nobody knows, nobody but Dr. Livy Uzoukwu: the youngest ever State Attorney-General in Nigeria’s history.
How the Buhari team will counter that petition in its remaining 4 days - we stay observing.
